What You Should Know About California Family Law

  • California is a no-fault divorce state. You do not need to prove wrongdoing to file for divorce. Irreconcilable differences is sufficient grounds, and neither spouse can legally block a divorce from being finalized.
  • There is a mandatory six-month waiting period. California law requires a minimum of six months from the date the divorce petition is served before a divorce can be finalized — but the division of property and custody issues can be addressed before that point.
  • Domestic violence history carries real weight in custody decisions. A history of domestic violence is a significant factor in California custody determinations. Courts take these findings seriously, and an experienced attorney can ensure that history is properly presented.
  • Not all property is divided equally. Assets acquired before the marriage, as well as inheritances and gifts received during the marriage, are typically considered separate property and are not subject to division — but tracing and protecting separate property requires careful documentation.
